 DEFINITIONS 

“TrollTraveler.com” , "Troll Traveler"means the web pages accessible via http://trolltravaler.com that are identified as Customer Resources, including but not limited to the Learning Center, Help, Blogs, Ideas, Answers, New Features, User Groups and user profile pages that show the TrollTraveler.com designation. 

“We,” “Our” or “Us” means TrollTraveler.com.

1. Acceptance of terms of use and amendments

You agree that all information you submit to the TrollTraveler.com profile pages is accurate and that you will keep it current. If We have grounds to suspect that your profile information is untrue, inaccurate or incomplete, We have the right to suspend or terminate your TrollTraveler.com account. It is your responsibility to maintain the confidentiality of your TrollTraveler.com password, and you are responsible for any activities that occur in your TrollTraveler.com account. You agree that we may send you important information and notices regarding  TrollTraveler.com and your TrollTraveler.com account by email, text messaging or other means based on the information you provide to Us. Each individual person is limited to one account.

15. YOUR RESPONSIBILITIES
You are responsible for all activities that occur in your TrollTraveler.com account. You shall treat other TrollTraveler.com users with courtesy and respect. You shall not:
  • Impersonate any other person;
  • Falsely say or imply that you are associated with another person or entity;
  • Submit content in exchange for payment or other consideration from another person or entity;
  • Collect information about other TrollTraveler.com users without their consent; or
  • Submit or link to any content that:
    • Infringes or violates the intellectual property or other rights of any person or entity;
    • Intentionally interferes with the operation of TrollTraveler.com;
    • Violates anyone’s privacy or publicity rights;
    • Breaches any duty of confidentiality that you owe to anyone;
    • Provides any non-public information about Us or any other company or person without authorization (including the names and contact information for Our employees or TrollTraveler.com users);
    • Is, in Our judgment, harassing, defamatory, abusive, lewd, pornographic, obscene or otherwise objectionable;
    • Contains or installs any viruses, worms, bugs, Trojan horses, malware or other code, files or programs designed or having the capability to disrupt, damage or limit the functionality of any software or hardware; or
    • Contains false or deceptive language, unsubstantiated or comparative claims regarding Our or others’ products, advertising, commercial referrals, spam, chain letters, or any other solicitation, including solicitation of lawsuits.
Please remember that you may be providing content for an international audience. Things that do not seem abusive, obscene, or offensive to you might seem so to others. 

We reserve the right, in Our sole discretion and without notice to you, to remove any content submitted or posted by you to TrollTraveler.com pages. 

16)Guest Books/Property Reviews. 
Any entries in the guest book or property, company agency or service provider review section of any member’s listing or profile must be genuine comments from guests who have stayed at the property advertised or who have experienced the services offered by the service provider themselves. The e-mail address(es) of the guest(s) and member(s) whose comments are given must be supplied by a member to us upon our request.  All content submitted in reviews must meet our content guidelines.    Please be advised that the reviews for a property, business, agency or any member or user of TrollTraveler previously listed on any TrollTraveler site may, at our sole discretion, be published along with that listing when a member purchases or adds a listing for that property, business, service or member on any TrollTraveler site.   

17.    Responsibility for User-Contributed Content; Translations.
We have no duty to pre-screen content posted on the Site by members, travelers or other users (including, without limitation, reviews of or guest book entries for any particular rental property), (collectively, “user-contributed content”) and we are not responsible for user-contributed content. We do, however, reserve the right to decline to permit the posting on the Site of, or to remove from the Site, any user-contributed content that fails to meet our Content Guidelines or if it otherwise violates these Terms. We may also remove user-contributed content if it is brought to our attention, such as by notice given to us by a user or any third party that any part of these Terms, or any other requirements governing the posting of such content, has/have been apparently breached in respect of such content.  Finally, we reserve the right (but do not assume the obligation) to edit member’s content in a non-substantive manner solely to cause the content to comply with our content guidelines or formatting requirements.

All property, business, agency, and service providers listings on the website are submitted by the member (who may be the owner, property manager, agent, represenative or duly authorized manager or agent of the owner, property, business or service listing provided ) and are the sole responsibility of the member, and we specifically disclaim any and all liability arising from the alleged accuracy of the listings, property reviews, guest book and review entries,blog posts and other content as well as any alleged breaches of contract on a member's part.  Members are solely responsible for keeping their property business or service information up-to-date on the website, including, but not limited to any and all representations about any property, business, service or listing its amenities, location, price, and its availability for a specific date or range of dates. We do not represent or warrant that any of the copy, content, property business reviews, guest book entries, blog & review entries of a property business or services location, suitability, pricing or availability information published or other details pertaining to the property business, member or service listed on the Site is accurate or up-to-date even in the case where prospective travelers have searched for specific special offers, dates, or types of properties.  Members are solely responsible for ensuring the accuracy of any property, business or service or service providers descriptions, and travelers are solely responsible for verifying the accuracy of such descriptions.

If any content created by members or users is translated for display on any website or any site of any affiliate of TrollTraveler, the member or user is solely responsible for the review and accuracy of such translation.  Unless we specify otherwise to the user or member, any translation services are offered by us free of charge.

We reserve the right to disclose any information as permitted by prevailing law to satisfy any law, regulation or government request if we determine, in our sole discretion, that we are required to respond to, or if it would be in our interests to, respond to such request.

18.    Links to Third Party Sites.
This website may contain links and pointers to other Internet sites, resources, and sponsors of the website. Links to and from the Site to other third-party sites, maintained by third parties, do not constitute an endorsement by us of any third parties, the third-party sites or the contents thereof.  We are not responsible in any way for such third-party sites or resources and your use of such sites and resources will not be governed by these Terms. 

19) Advertisements, Sales and Promotions 
TrollTraveler runs advertisements and promotions on its sites. By using the Service, you agree that TrollTraveler has the right to run such advertisements and promotions. You also agree that you will not attempt to block or otherwise interfere with advertisements displayed on or in connection with your Content postings. The manner, mode and extent of advertising by Troll Traveler on your posting is subject to change. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or through the Service, including payment and delivery of related goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and such advertiser. You agree that Troll Traveler shall not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such advertisers on the Service.

22.  Hypertext Links
We reserve the right to refuse hypertext links to, or addresses of, other web sites from member's pages, and to remove links or web addresses without notice at our sole discretion. Further, we reserve the right to charge for hypertext links at any time.

23. Vacation Rental, Property Managers & Service Proividers

ADDITIONAL TERMS APPLICABLE TO USERS WITH PROPERTY LISTINGS AND RELATED SERVICES & CONTENT

By registering or signing into your account on this Website as a vacation rental owner or manager ( "Manager"), you agree to provide accurate and current information about yourself as prompted by the registration process and maintain and promptly update your online profile information to keep it accurate and current, including but not limited to the information displayed in your account. By registering or signing into your account on this Website as a Manager, homeowner or agent with a listed vacation rental property (a "Listing" and collectively "Listings") on this Website:

(a) You represent and warrant that (i) you own and control all of the rights to the content, including text, descriptions, photos and any other content that you post or otherwise distribute regarding the Listings, or you otherwise have the lawful right to post and distribute such content to or through the Website; (ii) such content is accurate and not misleading (including, without limitation, descriptions, features, availability and rental pricing, and pictures (whether supplied by you or authorized by you to be taken by Troll Traveler from another web site or service)); and (iii) use and posting or other transmission of such content does not violate this Agreement and will not violate any rights of or cause injury to any person or entity. You also agree to promptly provide proof of personal identification, ownership of the property listed or authority to list the property as we may request. We reserve the right to refuse, in our sole discretion, any Listing. We may refuse to publish the Listing for any reason, and you hereby expressly agree to release and hold us harmless from any loss or liability that may arise from such a decision.

(b) As applicable to you, paid Listings are sold to run for entire term from the date of payment. Payment for subscriptions for paid listings must be made in U.S. Dollars paid either by major credit card or debit card. Such Listing subscriptions shall automatically renew at the expiration of the then-current term (30 days) for an additional term of the same duration as the initial term. This automatic-renewal allows your service to remain uninterrupted. If you do not wish for your Listing subscription to be automatically renewed, you must manually cancel your Listing subscription by contacting us at info@trolltraveler.com prior to the expiration of the then-current term. Upon any cancellation, your Listing subscription will remain active through your then-current term; however your Listing subscription will not be automatically renewed upon the expiration of this term. If your subscription is cancelled at the end of your then-current Listing subscription term for any reason and you thereafter desire to renew your Listing subscription, you will be required to pay the then-current non-promotional subscription rate to activate a new subscription. If you do not cancel your Listing subscription or if you continue to use our subscription service, you re-affirm and authorize us to charge your credit card at the end of each subscription term for an additional term of the same duration as the initial term and at the then-current non-promotional subscription rate. You agree to be responsible for any such charges, and we reserve the right to obtain payment directly from you if necessary. You may disable a Listing prior to the end of the term and thus remove the Listing from the Website, however, disabling a Listing will not cancel your subscription. No refunds or extensions of time are available for disabled or cancelled monthly Listing subscriptions.

(c) If we become aware of or receive a complaint from any person or entity regarding a member's Listing or rental practices that, in our sole discretion, warrants the immediate removal of such member's allegedly offensive Listing from the Website (for example, and without limitation, if a member double-books a property for multiple travelers on the same date, or engages in any practice that, in our sole discretion, would be considered unfair within the vacation rental industry, or if we receive a complaint that any listing's content infringes on the rights of a third party or the user has been fraudulently posting reviews or violation of this Agreement), then we may immediately remove the allegedly offensive Listing from the Website without notice to the member and without refund while we investigate the basis for the complaint. If we conclude, in our sole discretion, that any such complaint is meritorious, then we may permanently remove the offensive Listing from the site without notice to the member and without refund.

(d) You represent and warrant that each Listing displays an individual and uniquely identified property available for short term rent. Troll Traveler reserves the right to amend or remove any Listing, when more than one property is described, and may choose, in its sole discretion to retain any fees associated with the non-conforming listing as compensation for violating this condition. You agree that each Listing is subject to review and Troll Traveler  reserves the right to edit, amend, improve any Listing and the design, layout and functionality of Listings and the Website, in its sole discretion and without notice to you.

(e) You represent and warrant that the Listings will not contain addresses of other web sites, HTML, code or other markup languages, other than as provided herein. Addresses of other web sites, HTML, code, or other markup languages will be removed from Listings without notice. You agree not to place email addresses within your listings other than in the designated area to help prevent SPAM and discourage email harvesting robots from crawling Troll Traveler. Email addresses included outside designated areas will be removed from Listings without notice.

(f) You grant Troll Traveler, its affiliates, and licensees (i) a nonexclusive, royalty-free, perpetual, transferable, irrevocable right to use, reproduce, modify, edit, adapt, translate, distribute, publish, create derivative works from and publicly display and perform such content throughout the world in any media, now known or hereafter devised; (ii) the right to use the name that you submit in connection with such content, if they choose; and (iii) you grant Troll Traveler and its affiliates the ability to copyright and protect the images, copy and other content available via your Listing from the unauthorized use by unaffiliated third parties who may attempt to use such information and grant us the right to pursue at law any person or entity that violates your or Troll Traveler's rights in the content by a breach of this Agreement. You further agree to assist us-at our expense and control-to protect such copyrighted material from unauthorized redistribution. We are not responsible for any infringement or violation of laws resulting from content supplied by any member and each member will indemnify and hold harmless Troll Traveler against any action brought for breach of copyright or other rights from the use of such content. You hereby waive and release all rights to any claim against us for any alleged or actual infringement of any proprietary rights, rights of privacy and publicity, moral rights and rights of attribution in connection with any user-contributed content posted or provided to us. You agree that we may reproduce in whole or in part any photographic material supplied by you in the promotion of your property or the promotion of the Website.

(g) You understand that content submitted will be considered non-confidential and Troll Traveler, its affiliates, and licensees will be under no obligation to treat such content as proprietary information. Without limiting the foregoing, Troll Traveler, its affiliates, and licensees reserve the right to use the content as they deem appropriate, including, without limitation, deleting, editing, modifying, rejecting, or refusing to post it. Troll Traveler, its affiliates, and licensees are under no obligation to offer you any payment for content that you submit or the opportunity to edit, delete or otherwise modify content once it has been submitted to Troll Traveler. Troll Traveler, its affiliates, and licensees shall have no duty to attribute authorship of content to you, and shall not be obligated to enforce any form of attribution by third parties.

(h) You acknowledge that: (i) you will be responsible for adhering to all local regulations including, but not limited to, permits, licenses, zoning regulations, occupancy taxes, and safety compliance; (ii) Troll Traveler is not a property management company; (iii) prospective renters will contact you directly using the email contact, booking or payment forms or the contact information provided with the Listing; (iv) Troll Traveler is not  responsible for renters of property (it is your responsibility to validate the qualifications of the prospective renters and rent a Listing on terms and conditions acceptable to you); and (v) Troll Traveler may, at no additional cost to you, license third-party web sites to advertise the Listings in order to maximize the visitors to your listing.

(i) You understand that you may disable any Listing at any time (such listing will generally be removed from Troll Traveler within seven business days, however we are not responsible to remove the listing at any time nor are we obligated to).

(j) You agree not to post, email, or approve for posting, content, whether in Listings or otherwise: that violates the Fair Housing Act by stating a discriminatory preference based on race, color, national origin, religion, sex, familial status or handicap, or violates any state or local law prohibiting discrimination on the basis of these or other characteristics; that is false, deceptive, misleading, deceitful, misinformative, or constitutes "bait and switch"; that infringes any patent, trademark, trade secret, copyright or other proprietary right of any third party, or that you do not have a right to make available under any law or contractual or fiduciary relationship; that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment; or that employs misleading email addresses, or forged headers or otherwise manipulated identifiers in order to disguise the origin of content transmitted through the Website.

(k) As a Manager/ Owner or Agent, you may provide or approve Listings. You represent and warrant that all information contained in Listings will be true and accurate in all material respects and will not omit anything that may be material to the decision of a user interested in a transaction. You understand that renters and or buyers will rely upon your Listings and any misstatements or omissions about the Listing may result in liability and other consequences to you including but not limited to cancellation of your Listing and/or account with Troll Traveler. You expressly release Troll Traveler and its users from any liabilities or obligations that may arise from any misrepresentations, omissions, or misstatements in the Listings you provide to Troll Traveler (including Listings you approve) and others who use the Website. You may also provide limited additional rules of use for your Listings, but Troll Traveler will have no obligation to monitor, police or enforce such rules, and Troll Traveler will have no liability or obligation to you or to a renter for any violation of such rules. You understand and agree that Troll Traveler is a referral service only, and in no event shall Troll Traveler be a party to any rental contract or agreement between you and a renter.

(l) As a Manager, Owner or Agent you represent and warrant that contact information for past guests that you enter into the Website through our service or other automated processes (including providing contact information of past guests directly to Troll Traveler), shall be the valid contact information of past renters. If such contact information is provided in relation to a specific Listing, you represent and warrant that to the best of your knowledge such information is accurate and renters are truly and accurately associated with Listings that they rented.


(m) You hereby agree to allow Troll Traveler to send review requests on your behalf based on the contact information (email address) of past guests' that you provide and that Troll Traveler shall have the right to retain this contact information, including the guests' name and email address for record keeping purposes. Troll Traveler respects the privacy of your customers and our users and hereby agrees not to reuse this information for remarketing purposes. Real Estate Policies

All real estate advertised herein is subject to the federal Fair Housing Act, which makes it illegal to advertise "any preference, limitation, or discrimination because of race, color, religion, sex, handicap, familial status, or national origin, or intention to make such preference, limitation or discrimination." We will not knowingly accept or permit any advertisement for real estate that is in violation of the law. All persons are hereby informed that all dwellings advertised are available on an equal opportunity basis.


Laws That Protect You
444 Civil Rights Act of 1866. The federal Civil Rights Act of 1866 prohibits all racial discrimination in the sale or rental of property.

Civil Rights Act of 1968 and 1988 Amendment. In leasing or selling residential property, the Civil Rights Act of 1968 expands the definition of discrimination to include not only race, but also national origin, color, and religion. The Fair Housing Amendments Act of 1988 further broadens the definition to include age, sex, and handicapped status.

Fair Housing Act. The federal Fair Housing Act of 1988 and Title VIII of the Civil Rights Act of 1968 constitute the Fair Housing Act. The Act makes fair housing a national policy throughout the U.S. It prohibits discrimination in the sale, lease or rental of housing, or making housing otherwise unavailable because of race, color, religion, sex, disability, familial status or national origin.

Americans with Disabilities Act. Title III of the federal Americans with Disabilities Act prohibits discrimination against persons with disabilities in commercial facilities and places of public accommodation.

Equal Credit Opportunity Act. The federal Equal Credit Opportunity Act makes it unlawful to discriminate against anyone on a credit application due to race, color, religion, national origin, sex, marital status, age or because all or part of an applicant's income comes from any public assistance program.


Responsibilities
Home sellers, prospective home buyers, real estate agents, mortgage brokers and loan officers all have rights and responsibilities under the law.

Home Sellers' Responsibilities
As a home seller or landlord, you are obligated not to discriminate in the sale, rental or financing of your property on the basis of race, color, religion, sex, disability, familial status or national origin. Also, you cannot do so through your licensed broker or salesperson, who is also bound by anti-discrimination laws. You may not set any discriminatory terms or conditions in a purchase contract or a lease. Additionally, you may not deny that housing is available or advertise a property's availability only to persons of a certain race, color, religion, sex, disability, familial status or national origin.

Real Estate Professionals' Responsibilities
Real Estate agents, mortgage brokers and loan officers in a real estate transaction may not discriminate on the basis of race, color, religion, sex, disability, familial status or national origin. Equally as important, they may not follow such instructions from a homeseller or landlord.

Home Buyers' Responsibilities
As a home buyer, you have the right to expect that housing will be available to you without discrimination or other limitations based on race, color, religion, sex, handicap, familial status, or national origin.
